This site is the property of Honeymoon Designer, a trading name of McNeill Rigby Travel Ltd, and is offered to you, the customer, conditioned on your acceptance without modification of the terms, conditions and notices contained herein. Your use of this web site constitutes your agreement to all such terms, conditions and notices. Please be aware that Honeymoon Designer may revise these Terms and Conditions from time to time by updating this posting. Such revised Terms and Conditions will take effect as of the date of posting.
Use of This Site
This Web site is for your personal information, entertainment, education and communication. You should assume everything you see or read on the Web site is the property of Honeymoon Designer and its licensors or partners. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works, transfer or sell information without the prior written permission of Honeymoon Designer.
Fees & Charges
We shall allow two free quotations then there will be a one off charge of £25/€35 fee; Quotation being two differing areas or properties or dates. The fee is refundable to you on confirmation off your reservation.
There shall also be a credit card processing fee at approx 2% which will be levied on all deposits/balances. Further information on this will be with our confirmation paperwork and 'ways to pay'.
A service charge will also be charged on gift purchases, £50/€70 for twenty items and a further £10/€14 per further ten items. This allows us to amend/administer the site and personalise it to a much greater degree and to ensure that we are able to offer this valuable service. With this charge we also supply up to fifty Gift cards which will have your unique password for your guests.
We would like to assist you in ensuring that you do not incur these additional charges by taking payment by debit card (e.g. Maestro) cash or cheque which will not be subject to an additional charge.
Operator Terms & Conditions
Your holiday and reservations are held under the terms and conditions of the operator/operators through which your reservation(s) are made and it is your responsibility to be aware of the said terms & conditions. Staff will be able to supply the terms and conditions upon your request. As per the terms and conditions, operators demand that the balance is paid to them no later than (approx) 65 days prior to the departure of your honeymoon. This must be strictly adhered to and is outside the boundaries of Honeymoon Designer to alter the 'balance due' date, this being regardless of ‘Gift List’ purchases.
Alteration/Cancellation by the Organiser
Airlines/Tour Operators may at any time alter,change,curtail or cancel a holiday.
If this is a consequence of ‘force majeure’ (defined in subparagraph (b) of this clause, the airline/operator is obliged to curtail, alter, extend or cancel a holiday, the consumer shall not be at liberty to maintain a claim for compensation or otherwise for any loss arising of the said curtailment,alteration,extension or cancellation of the holiday. Where the Organiser makes a major change to the holiday the terms and conditions of that operator/airline applies.
(b) The term ‘force majeure’ means Acts of God, natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft or vehicle to be used in connection with a holiday, riots, acts of war, civil commotion, exercise of legislative, municipal, military or other authority, strikes industrial action, requisition of equipment, mechanical breakdown, shortage of fuel, insolvency or default of any carrier or service supplier connected with a holiday, fraud perpetrated against the Organiser or any other reason beyond the control of the Organiser.
Changes
Amendment fees will be incurred for changes. The fees vary dependent on the changes requested. All fees charged are pertaining to the Operator concerned.
Special Requests.
We will endeavour to satisfy any special request you may have. A ‘Honeymooners’ note will be added to all reservations for the airlines/suppliers. This however is not a guarantee on any special requests submitted.
Insurance
Insurance cover is for the individual to arrange to ensure adequate cover to value and/or departure point of said holiday. Insurance quotation is available on request from our office.
Complaints
If the consumer wishes to make a complaint in relation to a holiday, he must immediately inform the Organiser’s representative at the location where the consumer is where the complaint arises and shall, if the Organiser requires, complete a form setting out in detail the Consumer complaint. If the Consumer fails to comply with such requirement, the Organiser shall be entitled to recover the cost from the Consumer of any additional expense incurred by it in carrying out any subsequent investigation of a complaint which is found to be unjustified.
The Consumer shall be obliged to notify the Organiser in writing of any complaint within 28 days after his return to the port of departure of termination of the holiday whichever is the earlier.
Liability Disclaimer
Your use of this Web site is at your own risk. Honeymoon Designer does not warrant or represent that our content is accurate, error-free, truthful or reliable or that your use of such material will not infringe rights of third parties. Honeymoon Designer does not warrant that the functional aspects of the Web site will be error free or that this Web site or the server that makes it available are free of viruses or other harmful components. If your use of this Web site or our content results in the need for servicing or replacing property, material, equipment or data, Honeymoon Designer is not responsible for those costs. Without limiting the foregoing, everything on our Web site is provided to you "as is" and "as available" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. Honeymoon Designer makes no warranties about the accuracy, reliability, completeness, or timeliness of the material contained on this Web site, or about its software, text, graphics, and links, or results to be obtained from using the Web site. Please note that some jurisdictions may not allow the exclusion of implied warranties. As a result, some of the above exclusions may not apply to you.
Limitation of Liability
Neither Honeymoon Designer nor any other party involved in creating, producing, or delivering this Web site shall be liable for any direct, special, incidental, consequential, or indirect damages resulting from your access to, or use of, or inability to use this Web site and our content, whether based on warranty, contract, tort or any other legal theory, and whether or not Honeymoon Designer is advised of the possibility of such damages. Please note that some jurisdictions may not allow the exclusion or limitation of liability for consequential or incidental damages. As a result, some of the above exclusions may not apply to you.
Termination
You agree that Honeymoon Designer may terminate your use of this Web site if it believes that you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions, violated the rights of Honeymoon Designer or any third party, or for any reason with or without notice to you. You agree that Honeymoon Designer may modify or discontinue this Web site, with or without notice to you. You agree that Honeymoon Designer will not be liable to you or any third party as a result of such modification or discontinuation.
Indemnity
You agree to defend, indemnify, and hold harmless Honeymoon Designer, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, arising from your use of this Web site or our content or your breach of these Terms and Conditions. Honeymoon Designer shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.
Password
You will receive a password in connection with your use of the Gift List site. You will be responsible to maintain the confidentiality of your password and account, and will be solely responsible for all activities that occur under your password and account.
The Gift List
The Gift List shall be closed approximately 10 working days out from the wedding to allow McNeill Worldwide to action the gift list. The cheque payment to you will be payable in the currency your honeymoon is reserved in.
In the event of cancellation of the wedding, the Gift List shall be closed with immediate effect. The couple will be entitled to a refund from McNeill Worldwide to the value of the contributions excluding the service fees taken.
We are not responsible for how the wedding couple choose to spend the money within the Gift List account. We will continue to ensure satisfaction on the recommendations made, however we do not accept responsibility if the wedding couple do not enjoy the activity.
A service charge will also be charged to create the Gift List, £50/€70 for up to 20 items and a further £10/€15 per further ten items. This allows us to amend/administer the site and personalise it to a much greater degree and to ensure that we are able to offer this valuable service. You will also be supplied with fifty of the Gift List password cards which you can offer to friends and relatives with your unique password. Twenty further cards are available for £10/€15.
Your right to cancel
If the wedding couple change their mind in relation to their reservation we would remind you as previously mentioned that the terms and conditions of the tour operators apply. If, however, the couple wish to remove themselves from the Honeymoon Designer site they can do so by contacting our office within 14 days of the holiday confirmation being received.
Confidentiality
We observe a strict duty of confidentiality with respect to the wedding couple and we will not disclose your details including full name and address to anyone else other than those also bound by the same duty of confidentiality as we are, unless legally bound to do so.
Financial Protection
The air holidays and flights which depart from the UK are protected under the bonding of the Tour Operators/Organisers concerned in the reservation through ABTA and ATOL under the Civil Aviation Authority. Our own ATOL licence 4138 and ABTA 43398.
